Divorce and whose entitled to what

If you have pre-marriage savings, and get a divorce, can the other person claim half of them?

    There's no hard and fast rule really. Each case is different and you'd need a proper solicitor to guide you.

    If I remember correctly, assets prior to marriage are considered to be a gift to the marriage or something like that. Meaning whats yours is now both of yours. Technically the starting point is 50-50.

    One factor which can influence the final decision is how long the marriage has lasted for. A judge would probably just split it 50-50 if for example the marriage was 20 years but not if it were only a year. Also kids can also be a factor to be considered.

    Its very murky, best get a real solicitor.
