Paypal dispute questions

I bought some used car parts of an ebay bussiness seller who's auction was for a small item but mentioned breaking the whole car and listing other parts as requested.
I spoke to the guy over the phone and agreed which other parts I required. However he sent me a paypal invoice directly instead which I paid. This was an error on my part I know but I was in a rush to get the bits to fix my sons car.
Lots of promises but the parts never showed up and now my calls are not answered or returned.
I have raised a dispute and am waiting 20 days to raise a claim but as I understand it because the parts were not ebay listings I will only get a refund if the seller has funds in his paypal account, correct?.
I notice the seller is still trading on ebay and taking paypal payments. Does paypal freeze money withdrawals when a dispute is raised or is he free to make sure he has zero funds when we get to the claim stage?
