Writing A Will

Due to many misconceptions and scaremongering that I've read on here, I would just like to point something out that will hopefully prove to be moneysaving.

If you feel the need to write a will, buy one of the DIY packs from either WH Smith or The Post Office. They really are self explanatory and idiot-proof.

There is absolutely no need to consult a solicitor either prior to writing a will or indeed, after a person has died. Even if a will has been incorrectly made, you do not have to see a solicitor or pay anybody to sort it out after the person has died.

A phone call or visit to your local Probate Registry (listed under 'Courts' in the phone book) will suffice and this is a service provided by people who specialise in wills and nothing else.

    You are quite right that you don't have to have a solicitor draw up a will or prove it afterwards but and it's a very big but, if a diy will is not correctly worded the person or persons you wish to inherit your estate may not get what you want them to have. You may have saved money and you won't be here to see the outcome but is that really worth making a saving now? I know of a family who didn't get their inheritance because of a diy will where one little sentence was missing so they lost the lot. Beware!

    The packs might be written in idiot proof language. It doesn't stop idiots not following them. Having seen the devastating effects of an incorrectly executed DIY will, I would suggest that this is one area where money saving at the outset is a false economy for the people left behind.

    I do strongly agree though that solicitors do not need to be involved in settling an estate and they should never be appointed as executors.
