Capital one final response....HELP NEEDED!!!

Hi i am looking for help and advice on what to do next.

I started a claim against capital one for my partner who took out his credit card in 2004 whilst he was a serving soldier in the british army. We cannot find statements back to this date but ones from 2007 show he was paying PPi so i sent of a template letter to request this back as he would never have been able to claim if he was injured due to work as he was a soldier, but also if he was sick for any reason he received full sick pay so would still have been able to pay his bill.

Today we received a letter back saying that he did not orriginaly request PPi on his postal application(when he is sure he applied online and this was a pre-ticked box) and that he requested PPi to be added in december 2005 when he rang to activate his new card. Which he says he did not do.

They have stated this is their final response :( and will not uphold the claim, my question is do you think i should now go straight to the ombudsman or request a SAR??!! and if i request a SAR how do i do it and what do i need to say???

Any help would be most appriciated. I think they are doing this as it will potentially be a large pay out as he has had the card from 2004 to present and ppi each month is between £25-£30.

    Posted on the above thread, hope it helps, and the point here is that your hubby was covered and the policy was worthless to him anyway.

    I agree with Di, its worthless to him generally being in the forces so its an easy complaint if it has to go to FOS that is and as they have given you their final response I would get it sent to FOS now.

    Capital One argue that every PPI credit card sale was conducted on a non-advised basis.

    This means that its up to the consumer to check whether the insurance is right for their circumstances.

    If it was a 'non-advised sale', Capital One didn't need to check whether you had alternative cover or other ways of making the payments or advise you whether it was a good idea to take the PPI.

    Obviously I can't say what the FOS will decide because it's impossible to know without seeing the paperwork. However I've seen similar complaints rejected by the FOS.

    By all means send the complaint to the FOS if you disagree with the outcome however they might reject the complaint.

    Hello. The same thing happened to me. Cap On sent me my original application, I did not tick the PPI box, they said I was sold PPI when I re-activated a new card 2 years later. I can't remember doing this and asked for a transcript of the phone call which they can't provide.
    I have since written to the FOS but don't expect a good outcome from what I've been reading.
    Anyone see a pattern emerging ?

    Other than Capital One being a bunch of thieving prats that totally ignore any legal obligations to provide paperwork, hide behind a single telephone number refusing to let you talk to anyone in any other department and lie their way out of every situation?
