I received empty package. Who's liable me or the seller?

I bought a mobile battery from a powerseller. I received in the post this morning an empty envelope! The side had split open at the crease, so who knows if it was intentional or not.

If I contact the seller to tell him about this, is he going to turn around and say "I did my bit, I posted it off, nothing to do with me anymore".

What's the ebay law on this?

    its the sellers fault
    common issue with using envelopes for heavyish components
    the move back and forward in transit until the side gives way
    contact the seller and see what they say
    retain all the packaging

    Contact the seller - they have an obligation to get the item you bought to you.
