Help please - Debt collectors and SAR?

Hi all,

If you have a DCA chasing you for a mobile phone debt but want to send a SAR request to the network provider – can the DCA’s pursue you during the time you are waiting for a response or do you tell them it is in dispute? From what I understand the original creditor has a set period to reply to the request – what happens if they don’t respond?

Also if the DCA is offering you a settlement of half the balance or they will look to apply a CCJ – what is the likelihood of them doing so and does anyone have an idea of a timeframe? Can they do that while you are waiting for your info? A default was applied in October 2007 – 10 months after the last payment was made and therefore too late according to the ICO – but is that worth pursuing?

Any thoughts welcome!
