2nd letter to HSBC Flexiloan PPI

I have written a reply to HSBC's fob off letter from last year,I know bit slack but better late than never... Like your opinions/additions. Thanks
I’m writing to you following your response to my letter of complaint dated June 2010. In which I was seeking the repayment of PPI paid on my Flexiloan from 2004. Both of which I have enclosed for your reference.
In response to your reasons for not supporting my complaint.
Regardless of how good the policy was, and the fact it paid out irrespective of any benefits paid elsewhere. The fact remains that I specifically stated that I did not require the policy and was strongly advised that it would aid my application and I may be refused if it was not in place.
I consider this to be the point of mis-selling from a person I considered to be in a position of trust. I felt I had no reason to doubt what she was telling me and believed it to be true that my application for the loan would have a greater chance with the advised PPI being in place.
Unfortunately I no longer have the product information pack for the Flexiloan & protection plan and would ask kindly if it’s possible that this could be sent to me for forwarding along with my complaint to the Financial Ombudsman.
Finally, on the point made that premiums had been paid from my account since May 2004 and there is no record of me contacting HSBC to query the insurance or advise that I thought the policy was mis-sold.
I like the many thousands of other people was unaware that this money could be re-claimed until the press coverage surrounding the issue broke. And to be honest the £591.66 being claimed is not a massive amount of money certainly not to a major organisation such as HSBC. But it’s money that I would not have spent without being badly advised by one of your Representatives.
And of course there is no evidence of the conversation that took place. That is why for many years it has been the perfect sales ploy for financial organisations such as yours whose sale pitch is preying on the trusted naivety of it’s customers but with no paper trail.
I have been a loyal customer of this bank for 17 years and just want what I believe to be rightfully mine.

And that is basically the problem. If you are making an unprovable accusation then you either need to rely on something else being wrong or an error by the lender occurring or the complaints handler being generous.
If everything points to it being set up correctly and you being eligible for cover and having a need then a verbal accusation doesn't hold much strength.I am an Independent Financial Adviser (IFA).
