Hi, I know a friend who is disabled with young kids, he says he wants no-one to take his kids away from him, because he loves them, Can courts actually take the children away if parent can't look after them?

    Im no expert, but at a guess, if the kids are in danger then it would be odd if they were not taken away from the source of the danger.

    Being disabled doesn't mean that he can't look after his kids - it depends on his disabilities and his capabilities. My understanding is that Social Services will always try to help families stay together and will offer support to enable this. Haivng said that, we all know that there are horror stories of SS splitting up families seemingly without cause.

    SS do have a duty to keep children safe, though, so if your friend's disabilities impede on his ability as a parent to the extent that he cannot look after them, it is possible that the children could be placed elsewhere. This could be with other family members. The children wouldn't necessarily be taken away completely - he could still have visitation rights.

    SS have to take it seriously when a child is in danger or is neglected. You don't say whether either of these is the case for your friend's children, although you do imply that he can't look after them. This would almost certainly be neglect. Depending on the age of the children, it could also be placing them in danger. So if that is the case, then yes, the children could be removed fromt he family home and placed somewhere safe, whether it is with other family members, foster parents, or a children's home.

    In what way can't he look after the kids ?

    What care & mobility needs does the father have ?

    Which disabled benefit income is the father in receipt of ?

    Are the social services already involved in this family, and what have they said ?
