seller trying it on?

Bought an item off Ebay,expected date of delivery 4th May, left it till Monday and messaged them, no reply, messaged again Tuesday and they said that it must be lost and do I want a refund straight away so I said yes. No refund still today and no reply to any message asking where the refund was so opened a cse via ebay, now I have had a message from them stating that
"I am sorry that you have had to open a case agains us, unfortunately we will not now refund you the money until yu have written to us stating clearly you will and have informed ebay you wish to drop the case. AS soon as we receive this the refund will be on its way to you".
Needless to say, I have complained again to ebay as I know that this isnt corrects as I paid via paypal, but should I have claimed via pay pal?

Paypal claims are said to be more clear cut with timings but you can't open a paypal one now that you've opened an ebay one, don't close the case until you have had your refund including postage.0

Thanks I had tried to open a paypal one and they obviously said I couldnt, will see what they come up with, Its only £14 but its the principle, when I was selling I would imediately offer and give a refund, and this is a business seller as well so they should know that by being like this they will get poor feedback.0
