HI all, I bought an electronic buzz lightyear for my little boy. It stated new in box. I got it, yes all in box and appeared all tied down as you would expect. When I got it out I would swear it was second hand. There is chipped paint everywhere, it just seems dirty and there is even a splodge of green paint on buzz's helmet.
They retail at £43 and I paid £30 so I guess you get what you pay for. I have contacted the seller just saying I am not entirely happy and asking them to confirm they sent the right buzz and it is new.
Only one neg fb on their records it does state a person bought an item as new and it wasn't.
Shall I just cut my losses and leave a positive?

Seriously, you would leave a positive, why?
If it is not as described then ask the seller for a refudn on safe return, if they say no open a paypal claim for SNAD. Depending on sellers attitude leave feedback as appropriate once you have a refund. hi soolin, one thing I dont want to be is that ebayer that good sellers just cant please! I was using the forum to find out if i am being ureasonable! i know there are some excellent sellers like youself and would hate to tarnish someones rating if people thought i was over zealous! thanks for the pearls of wisdom, much appreciated.0

I certainly wouldn't leave a positive, as it's not as it was described in the listing, and it doesn't matter how much you paid for it, if it's described as new you are not being unreasonable to expect it to actually be new.
It really annoys me when things are not as described, I recently bought a CD which was described as being in good condition, but when it arrived it was really badly scratched. As I only paid 99p + p&p, and it did play ok, I said in my feedback that it was scratched but played ok and wasn't too bad for the price, but I was still peeved as I'm very fussy about my CDs and they have to be perfect, whether I'm buying or selling.Weight loss challenge 2/10lbs

I would certainly want a refund. Don't leave positive but give him chance to get back to you and put it right. He may have made a genuine mistake - it happens if you are listing lots of stuff in one sitting. It doesn't sound like it is in great condition even if it was advertised as second hand so I would politely ask to return it with a full refund including postage costs. It may make him more careful about honest listing if it actually costs in postage. If he won't definitely open a dispute. You are not being unreasonable.0

The seller is obviously hoping that someone like you will buy it & not want to be a difficult customer. If they went to the trouble of using the ties to make it look as if it hadn't been out of the box, then it's not a genuine mistake but a bad seller.
If they don't respond, with an offer of a full refund inc original p&p open a dispute. You will unfortunately have to pay the return costs.
No way should they receive positive FB, if they respond with an offer of full refund including both sets of p&p then I may leave a neutral. If I have to open a dispute then it automatically becomes a neg & low stars.

Can I just ask, was there a photo of the item? I know sometimes it doesn't mean a great deal, but what did the item look like. You have said "It stated new in box" but did this correspond with the photo.0

good sellers are the one to make every effort to be accurate when listing items, nobody is perfect, you may want to give them the benefit of the doubt and contact them, they may be happy to allow you to return.
If they are not helpful I would not leave a positive, if it was me. As I've said before here, since I've started selling I've become a fussier buyer, as I expect to be treated the way I treat my buyers, and if there is a problem to be able to resolve it without any hassle.
You have the right to expect high standards too, £30 is a good sum (although personally I treat all buyers the same, even when I had only one bidder for a 99p auction...).0 -
Thanks everyone, the picture was a stock picture, probably pulled from amazon or similar. The box had obviously been opened, you could see where the original tape had been cut and new tape put in place. I just don't know if I can be asked to repost it, it will cost around £5 and that is just untracked, if returning for refund I would have to send recorded and that would be more. I think I will see if they will consider partial refund, or agree to cover return postage costs, if they do this then I will leave a pos with a comment such as - I do not think new but seller was helpful in ressolving problem. If not then a neutral, as I am also at fault for not wanting to post it back. Does this seem reasonable?0
