Store Card from 10 years ago - HELP

After a bad break up, a new baby and post natal depression, I left my flat and moved in with my Mam. Admittedly there were things left unpaid.

I recently went online using my Experia account to apply for a small loan and since then have had a company contacting me regarding an outstanding balance for a topshop card, which I had totally forgotton about but do not have the money to pay off. The balance they say is £585.71.

I put the phone down on them, but they have been calling everday up to 5 times a day and I am scared.

This morning I received a letter fromn AKTIV KAPITAL stating I have an outstanding balance with GE Capital Global Consumer Finance Ltd for the £581.71 mentioned above - now I am even more frightened.

They say they want to help me pay the debt and have offered a 35% discount which I still can't afford to clear - £380.71, and they will clear the rest.

Last time I checked this balance and company were not showing on my Experian credit files?

Please can someone help me? :(

You still owe the money BUT unless they have a CCJ against you , or you made a payment or acknowledged the debt in the past 6 years, it is most likley 'Statute Barred' (uncollectable). Tell them so. It doesn't mean yopu don't owe the money, but they can't hassle you for it - from that point it is up to your consciennce.

How do I find out if they have CCJ against me? I have had no paperwork suggesting they have?

You could check the registry trust website, but as that costs £8 a check, personally I wouldn't bother.

If there was a CCJ in place then Aktiv would have said so. They also wouldn't be likely to be starting with a 35% off offer.

If there is a CCJ, then it's up to Aktiv to show and prove that.

There is info and letters to send in the following link:
