Ebay late delivery, then misdescribed item

Hello all,
Almost two months ago, ordered a phone from Hong Kong to where I live in Germany. When it finally arrived last Friday - following various issues with customs and the post office - it turned out that it had an azerty keyboard rather than the qwerty one that it was sold with. The ebay seller is being awkward, and ebay says that I only have 45 days to declare a problem to them. That deadline was before the phone even arrived.....
Is there anything that I can do?

As you are in Germany the rules that we understand in the UK may well be different.
