I filled out forms for husbands DLA for a supercession and on advice of our GP who agrees we should be entitled to High Rate care.
He currently gets Lower mob and middle care.
As he now needs care at night and day for continuous and regular periods - all of this was put in forms, but DLA have assessed forms and say NO CHANGE.
It is obvious from the forms he needs care day and night and we do fit criteria - it's like they haven't read the forms.
What the next step to take:
1. Write an ask for a tribunal & ask them to look again at the decision stating the points they have missed from form that would entitle him to it.
OR
2.do you ask for decision to be looked at again and depending on result then write for tribunal.
OR
should I not ask for them to reconsider decision and just go straight for tribunal.
Thanks - any advice appreciated.

If you say that you wish to appeal, they will automatically reconsider before submitting it to tribunal. Did you submit supporting medical evidence?Gone ... or have I?0

Thank you - Supporting medical evidence of his needs and disabilities yes. Just can't see why he hasn't been allowed higher care, when he needs help every night for over 20 minutes at a time to prevent danger to himself and others. They have agreed he needs the help in the day, why 'they feel' he doesn't need that same help at night baffles me.

The night care one seems to bit hit and miss - I know of people that have been awarded HRC for seemingly few overnight needs, but others that can demonstrate need but not been awarded it.
I would appeal, but before you send in your appeal get someone else to read it and ensure that his needs are clear. Sometimes an outside view can help to clarify what you written.Gone ... or have I?0
