child tax: double claim

in a stew with tax credits. As helpline cant verify me they wont talk to me. I work 6 days week so cant really go to tax office for face to face as they want. I did do this over xmas but the lazy gits sat there doing nothing but not one would look atr my documents casue i had not booked an appointment.
anyway the prob is a disputed payment. In july my child went to her mother for a stay after she finished her exams. After the 2 weeks were up she did not come back. I called her mum who told me she had thrown her out cause she would not come back. I got hold of her and she told me she was not coming back. I was unsure if she meant this as we were awaiting the keys for a new house.
As she was 16 i called tax credits and cancelled them as she did not want to stay at school. I carried on claiming in case she did come back as i would need the last few weeks to help pay for things.
THe house was not ready until after the last payment so when she did not come back i did not have any claim to cancel, as to me the rejection of the house made it final she would not be back
During this period she was lioving in various locations, at friends and family (on her mother's side) homes
in transpired she did move back to her mothers in nov/dec time which is when i got the tax credit letter. someone else was making a claim for the tax credits i was paid from july 1st to sept 1st.
i appealed this as i feel it is unfair to judge this with the hindsight my child did not come back. no-one claimed through this period or informed me they were responsible for her and wanted the tax credits.
This is a blatant attempt by her mother to claim some money for her. I have told the tax credits in my appeal that
1) she was dues back after 2 weeks
2) i was awaiting a house so kept the claim on the hope she would come back
3) i have texts and facebook post showing my daughter was not living with any one person,least of all her mother,through that period so can not see who is claiming.
4) no one claimed in that period, why only in dec when she moved back to her mother?
as i say its easy to look back and say i didnt have her,i dont get the ctredits but i did not know this at the time. I thought i would at least be allowed to keep the first 2 weeks as she was only visiting her mother and i had no idea of what was to happen.
where do i stand here? I dont mind paying back the payment but dont want her mother to claim as it can only be her making the claim. She has probably given them a load of bull that my daughter was only saying she was not there cause she didnt want me to go and get her etc etc.

There seem to be 2 parts to this - whether you should repay and whether her mother can claim. You do seem clear on the fact that you need to repay the money as she did tell you she would not be returning to live with you though you could try disputing the 2 weeks where you believed her just to be on holiday. As for stopping someone else claiming, I don't see how you can do that (though others may have ideas). The only thing I can think of is to wait until you are sure she has claimed and then report her for fraud.0

How come one miunte you are stating someone is trying to claim from 1st July - 1st September, then you come away with the above only in December?where do i stand here? I dont mind paying back the payment but dont want her mother to claim as it can only be her making the claim.*SIGH*0 -
That doesn't make sense, how can you cancel something then carry on claiming it?

No one needs to tell you, her mother is perfectly legal to claim without having to inform you.
Last time her mother threw her out and took her back 6 months later she put the claim in straight away and the tax credits wrote to tell me and the payments were stopped.Good god a mother claiming benefits for her child, shocker!
How come one miunte you are stating someone is trying to claim from 1st July - 1st September, then you come away with the above only in December?
because they are claiming for the period 1st july-1st spetember but did not submit the claim until novemeber/december!!
