My sister is a single mum with 2 boys 7 & 9
she has a mortgage of £100k. £12k of arrears
she works 6 hours a week for £30.
she has not worked since 9th Feb 2011 so I took her down the doctors for a backdated sicknote. she took an overdose last month and has madelung deformity.
and receives £5k in child tax credits plus child benifits
She did not know she could claim anything else.
She only told me Sunday she is in court tomorrow/Wednesday about being evicted. for the 3rd time- 1st time Oct 2010 judge told her to pay an extra £50 each month (on top of £514 normal amount), to start paying back £12k of arrears. she kicked her boyfriend out (xmas)as he would not help with the mortgage. she went back to court (Jan 11) and the judge gave her another chance she paid £260 Jan, £604 Feb & £160 march-she has untill the 28 of march to pay.
but the mortgage people still want to evict her as she has always been a bad payer. I phoned them earlier.
I phoned the DWP for her to claim income support-that is what they advised and some mortgage/council tax help.
It would help if I knew how much she could get so i can tell the judge tomorrow.
Can anyone give me any advice
Thank you in advance

If she is in alot of arrears and hasnt been paying I dont know if you would get any help with it. As they will only pay towards the interest not the capital. So if she is in arrears with capital this will still need paid. Plus if she is being evicted they might not help.
How are are the children? If over 7 she cant claim income support.
Why did she not try get some help first time she was in court? Did she think it would just disapear?0 -
The children are 7 and 9.
We all knew she had problems but not to this extent.
not sure why she didn't sort it out earlier!
she is 12k in arrears paying it back £50 a month0 -
Is she seeking more work? If so, she could claim JSA. As part of this she can claim SMI towards the mortgage interest, but as karenx has explained this will not cover any of the arrears, even if they have been capitalised.Gone ... or have I?0

There comes a point where it isn't worth trying to own a house.
This would appear to be an example of this.
What rate of interest is she paying? Is it repayment or Interest Only? (What is she going to do when interest rates rise???)
[fag packet calculation suggests repayment mortgage at 2.25%?]
Who's names are on the mortgage and title deeds and how much is the house worth?
What does she normally earn when working?
Who pays CSA and how much does she get?British Ex-pat in British Columbia!0 -
Get her to phone the Shelter home owner helpline asap. Their site lists the various govt schemes available to help prevent repossession.0
