    Assuming you don't work and there is no pension income or savings over £6000
    He should have been getting a basic rate of £111.45 per week, whilst on appeal.... That is the couple rate for ESA

    I don't recognise £105 as a weekly amount but it sounds like it could be IB single person rate + an IB premium - are you sure this is all he was getting on ESA and it does not include other benefits like DLA? OR it could be he was on £111.45 per week with a £6 per week deduction = £105

    He needs to check that they have included you on his claim under an ESA IR award, and what amount it says under the ESA IR award.

    Now that he is in Suipport Group he should be on
    ESA basic = £111.45 +
    Support Component £34.05
    He may get another premium if he is on DLA or a pensioner

    Unless he was entitled to more than that on his IB/IS claim, in which case he should still get the same amount he was on on IB/IS

    He should be paid arrears now to the time when the appeal started.

    And he no longer needs to supply sick notes.

    The stroke wont come into the appeal, you cant even mention it as is wasnt present when you failed the WCA.

    I don't have the exact rate to hand but £105.75 was the couples rate pre April, when the OP first appealed!

    thank you for your feed back..its all sorted and i have recived my money that was back dated...i had my back payment and my normal money within 3 days of the payments office receiving the letter off the esa saying tha we had won the tribunal.....for a couple we get 154 a week because he was placed in the support group....it has been a hard 20 wks but i defo think tha phoning the esa made my payments come through quicker...dont be scared to ring and ask about your progress..also i faxed my letter from the tribunal to the payments department and recived a payment 3 working days after ..so there are some people in the departemant that will try and help ...hope this helps abit
