we won our tribunal on the 23 /06 /2012,,,,the esa recived the letter on the 4/07/2012.....we have been on appeal rate since the 24/02/2012.....we where originallly on incapcaity benefit but was told we had to go onto esa ..we failed the first medical and was sent to tribunal to which we won...we have been put on support group....can anyone tell me if i will be back dated and also how long this ruffly takes thank u x
Assuming that the DWP do not appeal against the decision, then you get paid the difference between what you have been paid, and what you would have been paid over the period you were appealing.
So you get the entire amount backdated from 24/02/2012, till whenever they put you on the support group rate.
It is likely to take several weeks.
Phoning them every week to check may or may not speed it up.0 -
its been nearly 7 wks since we won the tribunal..the esa are still making up different stories when i ring them...today now hey have still not put us on the computer has even winning the tribunal i have contacted my local cab who say this is unacceptable and are going to ring them on my behalf tomorrow....this is soo strressful had to have a crisis loan today just to have gas ...iam starting to feel like iam on a roundabout just going round in circles
......they just rung me and it takes 7 wks for it to get from th decision maker to the payments departement..its a long process...so if u had a sigh of relief when you won the tribunal and you thought it was all over with think again

U shouldn't phone up DWP and sadly you have to wait and be patient for a letter and then they will backdated you. Remember DWP is very tricky and they did recieved your tribnal victory but it put it away and wait bit longer for you to bemoaned and they will probably will tell you to pop down to jobcentre with your copy of your tribnal victory, but don't do this!!! You could faced reassessment again!0 -

flight 747 i dont understand what u mean by i shouldnt phone them..its not me that is ill its my partner so i would imagine its fine for me to ring them and ask them about progress...i understand ur angry with them i am to ..but i belive its my right to be able to ask them questions etc ..

mynameistallulah thank you for your reply...iam waiting on a phone call tomorrow morning at 9 o oclock off them..they are said they where going to look into what has happened to my claim today and ting me with informtaion tomorrow....they said it is there and is waiting for the decision maker to sen it to the payments department...dont know how long it takes for the payment department to process the mony though but hoping its not aslong has the esa decision maker x0 -
well had a phone call and the decision makers have finally approved my trinubal and passed it on to the payments section...dont know how long tha takes ut getting closer0

You must never, ever be patient and wait.
This is not to be awkward, or to badger them, but to take into account that mail goes missing.
If your letter has been lost, and you wait for over a month, as you suggest, then you lose your automatic right to an appeal against any decision that has been made.
The best times to phone are tuesday to thursday, at about 10AM, for a quick answer.0 -
iam confused...me and my partner been on 105 a week since the transfer from incapacity benefit to esa...it didnt go smoothly and we ended up having to appeal and then a tribunal which we won..hes been placed in support group with support component ( whatever that means )...this all began on the 24 the feb...i was told that 105 was a appeal rate but now been told that 105 pound is what a couple is entiltled to on esa support group which means i want get any back money....also because we was switched from ib to esa does it mean it we went on to the main phase straight away..??...iam soo confused because they told me to look on the goverment site to see my entitliement and that means esa for a couple on support group is only 105 a week ........wish sumone knew the answer to all this beacuse i dont0

I had my medical with dwp in feb 12 which i failed because i got 12 points i have appealled against it and been getting paid £71 a week then last week i was told i have won my appeal and will be getting £99 a week which i got originally am i entitled to any back money from the difference i have been down each week £28 a week0

I had an Atos medical in December, failed to get any points, I have sleep apnoea & osteo arthuritus. I am taking it to the appeal tribunal, in the meantime I have had a stroke which my carer informed them about. I have heard nothing since& I am still on ESA. (the basic rate)0
