Fake shoes returned but now lost in post

I bought a pair of shoes that were an obvious fake. The seller agreed to refund my money. I returned them using Second Class Standard Delivery and have proof of postage. In retrospect I probably should have used Recorded Delivery but I have never had to return anything before, or had a parcel go missing.
After three weeks the shoes have not arrived and the seller refuses to refund my money without a tracking number. I have opened a dispute with ebay, she is accusing me of keeping the shoes even though she still has my money.
Should I try to claim the cost back from the Post Office or should she do this? Any suggestions please.

Your only route now is the post office using your proof of postage. Without tracking eBay won't want to know. You could always try ringing the sorting office for the area of the seller, and ask if they remember delivering anything recently, that matches your description. Then get back in touch with the seller with your findings. I've done this before, and the parcel miraculously turns up the following day...Sadly there are dishonest folks out there. And if she's bad enough to be selling fakes online, trying to con people, she's bad enough to have received them back and lying about it, it would have made me send tracked for that reason alone really. As you do not have any proof of the seller signing for them you are on a sticky wicket and will probably lose any claims through paypal or ebay. All you can do is as the person above says.Lifes a !!!!! and then you marry one:D0

If she is selling fakes knowingly, then I would think she is the type of person who would pray for a return to come standard delivery, so she can claim they never arrived. Looks like she wins this one. You can claim via the royal mail though with your proof of postage. Print out your ebay invoice for the proof you need to send to them. You can also orint out the claim form from the RM website. It will need to be posted into them though.0

I know it's a bit late in the day but you would have been better off opening an ebay dispute as the seller would have to prove the items were genuine, (unlike a Paypal one where the onus is on the buyer).
Also Tecniclly Sending known fakes through the post is illegal. As others have sais though claim via RM with proof of posting but don't mantion the F word.'The More I know about people the Better I like my Dog'
