Ebay fake silver jewellery - seller asking me to close case before she refunds

I have opened a case in ebay resolution centre after receiving a 'fake' sterling silver piece of jewellery.
The seller has emailed straightaway to offer a refund but says I have to close the ebay case first in order for her to be able to do this.
I know that once I close the case I have no further recourse to ebay and so obviously won't do that. Instead I have forwarded her emails to ebay customer services and askd for their help.
But this is now the second time that a seller has told me that they cannot issue a refund while a case is open (last time was when I helped my dad process a paypal claim on a faulty item - we ended up having to wait for paypal to decide in our favour).
So my question is: have I just happened to come across 2 sellers trying it on individually, or is there a genuine reason why a seller can't refund while a case is open?

No way would I do that. You close the case and the seller laughs at you.
It's simple, all the seller has to do is go into Paypal (I'm presuming paid with Paypal) and click one button to return your payment.====0 -

That's exactly what I thought - I just wondered if there was any other explanation for two sellers saying the same thing in the course of a week.0 -
Definitely DO NOT close case until you have a refund.
You'll have to send it back tracked though to win the dispute...Should've = Should HAVE (not 'of')

OK, so the seller has now replied very quickly saying:
'If I send you £xx(full amount) directly from Paypal, perhaps ebay will accept that we both want to close the case. Will this be satisfactory to you? I don't need you to return the item! xxx (Seller)'
The seller has a huge feedback score with only a few negatives. However there are a handful of comments among both the positives and the negatives saying the items are not genuine silver (why people would leave a positive for a fake is beyond me!)
I'm tempted to leave it for ebay to investigate as she is clearly ripping people off... even if it does mean I lose a little on having to return the product!0 -
Due to the Hallmark Act I think this is one area that a consumer has far better protection and a buyer is in a strong position if a seller is also in the UK.0

I haven't had a refund in ages, but I think as soon as he gives you the full refund it will close the dispute.
Don't hold your breath waiting for eBay to investigate the fake, once you get your refund they wont give a damn, its too profitable for them to stop all the fake sellers.====0 -
The seller has now refunded and asked me to close the case. She is a top rated seller with multiple listings for 'silver' jewellery. She has several neg and neutrals stating the jewellery is poor quality/fake and she has replied to most of these quite aggressively.
If I leave the case open will ebay be likely to take action against her?0 -

I have checked paypal and she has not refunded my original payment but has made a payment to me of the same amount. I am guessing she must have sent it as a gift as no fees were taken?
The ebay case is still open.
I don't want to be mean to her and certainly don't want a refund twice but I am concerned that she is still selling fake goods and I'd like ebay to be aware.... I don't know what to do next?0 -
When I had to open a case for SNAD before xmas, I got the refund and that closed the case automatically.
You've had your refund, put it behind you and move on. Ebay won't investigate.0
