Landlord Responsibility to replace

If an item is described in the inventory and that item ceases to function, i.e. American Fridge Freezer, is it the landlords responsibility to replace it with the same thing or can he provide just any old fridge freezer?

  • Im a landlord and if my american fridge freezer broke I would just replace it with a normal one.
  • No, they can replace it with any old rubbish, even a dirty second-hand one as long as it works.

    Bit unfair if you start the tenancy with top of the range appliances, presumably reflected in the rent, and end up with korean carp at the end!

    Most American fridge freezers offer more than the bog standard, like ice and filtered water on draught, so I would think the tenant would demand similar.

    Complete aside::: If it's only mentioned as a "fridge freezer" in an inventory listing, then perhaps the tenant could also replace it with any other fridge freezer at the end of the tenancy?
  • Thanks for your comments. The inventory does state make and model and description including shelving, ice maker and water dispenser etc. I really need to know my legal rights before I really kick off at the agent and landlord though.

    im a landlord to its unlikely you rented the property because it had an american fridge freezer but i suppose its relevant if your paying a reallt high rent in south kensington or something-if not if you complained to me id probably give you your notice as you would be indentified as a problem tenant and replace you with someone who will pay a higher rent - theres loads of supply about at the moment and rents have gone up

    There is no legal requirement for a landlord to replace an item with an identical one or one of a similar standard/style, though from a landlord/tenant relations point of view (as your post has proven), it would prevent disputes and disappointment.

    and get the rent associated with cheap appliances rather than decent ones.

    I'm sure someone wouldn't rent a property just because it has an american fridge/ freezer, but if that is indicative of the style of fittings in the property then that is what the tenant is expecting and paying for.

    If a power shower broke, could a landlord provide a rubber hose style attachment for the bath taps and expect tenant to be happy?

  • A landlord would not accept a lesser model (ceramic hobs come to mind) if a tenant damaged or broke something so why should the tenant when the appliance fails.

    Might be asking a stupid question - surely it's better to check with manufacturers first to see if it can be repaired before going down the road of replacment? I wouldn't be so keen to replace a big expensive item in any event without finding out whether a spare part and an engineer wouldn't solve the problem easily, and for a lot less cost than replacing it with a new lower spec item. Why not contact the manufacturers or their agent and ask?
