Okay about to buy a house with quite large rear garden, and drive leading down the side of the house to it.
There is a fence put up that seperates our full size drive from next doors much smaller one. (could only really get motorcycle down their side) The fence would be owned by me.
Amongst other things, i own a large motorhome.
With the fence up i cannot get the motorhome into my rear garden.
If i take the fence down i can.
The front garden is large enough to park both the Motorhome and our two cars, but i know that some people would consider it a pain and an eyesore.
If you were my next door neighbours would you prefer me to take down the fence and park the motorhome in the back garden and out of sight, or would you prefer me to leave it out and the fence up?
One more question, these neighbours currently have thier house up for sale. I was wondering about offering to put a brand new fence up but move it over by a foot allowing them to show the house to buyers with new fence and no motorhome, and as they would be moving out, the extra foot would not make any difference to them.

Even if you took the fence down you'd need their permission to run 1/4 of your motorhome down their land whenever you wanted to get it in or out. Assuming that the current neighbours are OK with that, you can't say (and nor can they) that the new ones will be.
As to moving the fence, that would mean effectively pinching part of their land - which could well cause issues when they find a buyer who discovers that the boundaries don't match the deeds.The only way to do that would be to do it properly and buy it off them.0 -
You could take the fence down and agree joint vehicle access for both properties.

That would have to be done either prior to or as part of the legal aspects of the neighbour's sale - otherwise the future neighbours would not be bound to it. Indeed, they may not agree at all which could be a deal-breaker for the current neighbour's sale.0 -
Or maybe take the fence down and have an access agreement drawn up that gives both properties right of access to the rear then you can park your motorhome round the back and they could build a garage that they could also access....win win all round.
Don't know what implications there would be over maintenance etc though.0 -

i bought my 2 close neighbours flowers, bolttle of wine and chocs when i bought the house and invited them to my new house party.... to my amasement none even bothered to even say hello or sent a postcard .
being a semi detached, on the side entrance walll , my wall, i did put some brackets and store there some tools and materials all in good order every time.
2 days ago one of them told me that ''every time i come on side garden(we are seperated by a small fence) this is an eyesore for me and my friends , he said .
i tried to be resonable but he wouldnt have it so i told him to live with it....my property my money and you didnt contribute when i went to buy it so you have no say
and oh..i told him that his smokey ford escort was the eyesore of the whole street and we all cant wait till you buy a new one0 -

You can't just decide to take a fence down to enable you to use someone else's land for your own purposes. Even if the fence belongs to you, neighbour would be perfectly within their rights to immediately erect a replacement fence on the boundary line.
They may agree to your proposal if they think it will make the house more saleable to have a drive wide enough to drive a car down. If not, you will have to take your chances with the new occupants. What if they have children, or dogs? What if they just don't want a shared drive?
If you really need to be able to park your motorhome at the back of the house, buy a house with a drive wide enough to allow this.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

I'd let you take the fence down, ignore the fact that you had to drive over MY land to park-up your caravan, then whilst you were away one day put a fence up on MY land. Best of both worlds your motorhome is parked out of sight and there is a fence.

Reminds me of a friend who came into some money and bought a saab motor car just because he'd always wanted one. Trouble was, he couldn't drive so he relied on his son to drive him everywhere. When not in use he used to park the car at the back of the house, which was often for long periods of time.
Anyway, he decided to erect a fence down the side of the house. So he measured up the car and erected his fence. Next time he came to take the car out, he discovered that the fence was 2" too close to the house.....I'm a retired employment solicitor. Well, there is a brick line (not a wall, just an embedded line of bricks) that runs down the dividing bit between the two houses, and the present owner of "My" house has put the fence up about a foot over to our side and the start, but it's a bit like "The Wavey Line Grocer" (as my mum would say). Further down the brick line comes over to our side a bit, but that part of the house has a lot more room.
The bricks are laid lengthways and are about 1ft wide, so if i took my fence down and they put one up on their side of the bricks then the van would fit with no problem. I really only need about 8 spare inches!
The property is currently unregistered and the sellers solicitor has just sent over the plans for approval to the land registry, but the scale is so large, and drawing so small that it really is impossible to clearly define the land anyway. So the line of bricks seems the most logical thing to go by.
As for giving them a share of the drive to enable them to get a car down their side too, i had thought of that, but i know a lot of people have had problems with neighbours parking in the shared part and getting blocked in, so didn't really want to go down that route.Was a 40 a day smoker for 20 years.

That would be perfect actually, if they put up the fence on Their land.
I'm only talking about 8 inches.
