Jean-Partrique

On the 30th November I put a telephone order in for a couple of items as Christmas presents from the Jean-Patrique Christmas 2010 Special Holiday Offers catalogue. Obviously nothing turned up, no money was taken and I bought alternative presents. Today, 27th Jan 2011, I check my bank account as it is the end of the long month and Jean-Partriqe have taken the money out of my account and I am now overdrawn. I rang them on the alternative 0871 no. and they stated that although it is now 2011 they are still fulfilling 2010 orders. Yes, I have the right to refuse, but that will cut no ice with the bank. I received no notification from them about the fact they were finally getting round to fulfilling their Christmas 2010 orders. If they had contacted me,I would have told them they are too late.

    So you didn't cancel your order?

    Without any confirmation that they were not going to fulfill your order, you were taking a risk by ordering elsewhere as well, weren't you?

    I would cancel the order now under Distance Selling Regulations and get all your money back from them.

    Any bank fees are down to you I think.

    I tried to get through a couple of times in Dec but just was held in a queue. When you work during the day, it’s not easy to make calls. By Jan, I had forgotten about it. Who would think that 2 months later, they would suddenly find the order and push it through? Was mine lost or is the normal for Jean-Partrique?
