Hi gang, this is on the back of a thread I previously done. I was in an accident 8 weeks ago and wentthrough their insurance for personal injury quote an received an offer today of £1345.00. I am undecided on what to do as I have never had this kind of claim before, I have a friend who had a claim in and there was nothing wrong with him, he had one doctors appointment and one assessment and he received £1850.00 it seems to me that the genuine people get next to nothing and those who are non genuine with no injurys get more!!
The insurance woman said it is non negotable and I can seek legal advise if needed which I did, winn solicitors were not interested one bit in pursuing the claim and said it seemed a fair figure. I put the case of my friend to them and they said everycase is different.
Any advise where I go from here?
Many thanks for any advise.

Symptoms were a dead right arm for two weeks, lower back pain for two weeks, neck pain for six weeks, I was off work for one week which I was paid for by my company and I was also threatened no to put a claim in by the person who hit me. I have also been stressed out due to the rack that my car is still damaged ad they are humming and harring if they are going to fix it.

Seems a bit on the low side to me, I certainly wouldn’t settle at that level until you are completely recovered so a proper assessment of any residual restrictions can be made.

On the rest of it, don’t forget you can claim out of pocket expenses for additional costs incurred and your boss can get the sick pay they gave you back off the TP insurer.

Also, tell them you will not even consider settling the injury claim until they have taken care of your car to your satisfaction. Don't be in a hurry to settle the injury claim. The longer it's open, the more pressure on the claims handler to close it.

It's not too late to give your case to your solicitor/a claim handler to sort out for you.
  • Thanks for the help, I have tried getting a solicitor/claims company to take the case on but they don't seem interested one bit, they said it seems a fair offer but if I am not happy to let them know which I did but they said it is the final offer. Don't know where or what to do now. Just wish I had lied through my teeth as this is what seems to get a decent offer

I agree this seems a bit too low. I hit someone last year (well rolled into actually - almost 0 MPH) and she had only bruising. She went to doctors and claimed a different chain of events and eventually the Insurers had to part with the best part of £3,500. Initially they said they were going to offer her £1,000 so I assume she refused this and that's when she got a legal expenses company involved.

Be sure not to accept too soon. The accident might have caused you longer term problems than you realise but if you accept the offer then this would be in full and final settlement and then you haven't really got grounds to go back to them again. But also beware that something like this could go on for quite some time (every case is different - my fault one was 10 wks from date of incident but my current non-fault, I have been pursuing for at leat 4 months and not even an acknowledgment of liability) and you may have to supply reports, receipts etc for every item you want to try and claim for. Good luck!

Your own solicitor would surely take this on - though if you have been independently advised the offer is fair, what more do you want or expect anyone could do?
  • I think i was advised because it was so late on in the process and they would not make much money out of it so i beleive they just said this, going of what friends of mine and work colleagues have been awarded i dont think it is fair, hence the reason I am on here.
  • one last thing, if i accepted over the phone is that set in stone or is it when i cash the cheque at my bank??????
