Changing ESA Appeals Tribunal date (possibly)?

I've just received my EAS Appeals Tribunal date (late Febuary) but I may have to request a date change.

Does anyone know how long I would have to wait for a new date?

You could be waiting another year, or even have to start all over again.

A relative of mine who works in the tribunal service, told me just yesterday, that if you dont show up for an ESA or DLA TRIBUNAL the whole appeal is refused, you have to go back to square one to start the whole thing again. You also can not appeal to a higher court now, the tribunals decision is where it ends.

The only way you would get another date is if you have a bloody good excuse, to be quite truthful you are lucky to have received your date. Many people have to wait over a year to 18 months for there's, if you have another appointment on the same day I would advise you to change the other appointment, as the tribunals are now so strict, they wont take any messing around.

to me it would have to be one hell of a reason before I would even consider a postponement of a tribunal.

Are you refering to just if someone does not turn up for a tribunal?
If they have scrapped upper tribunals, they have kept it pretty quite?

I hope your friend has the wrong end of the stick, or I do.

Upper tribunals cant just be scrapped without it hitting the news.

The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that

There are now no upper tribunals, this was enforced in the first week of January.

They can now also have a tribunal with out a Doctor in attendance sitting on the bench, as long as they have the medical reports the tribunal can go ahead.

Do you have a link / source for that?

You will have to find your own link, my relative actually organises the tribunals for the S.Wales area, these are the new rules.

I wonder if they are asking a representative of ATOS to sit on the bench instead?

It makes sense as they are the current leading experts in ESA assessments.

The last doctor on my last tribunal did not even hold a licence to practice medicine...

If you already are going through an upper tribunal it will go ahead, this has started from the first week in January, so any tribunals after that date, are refused for an upper tribunal.
