HSBC Loan PPI tied up with this Judicial Review

Well I have just got off the phone from the FOS and it seems that my PPI claim that was advised by the FOS to be upheld and paid back in early September, is now stalled pending the outcome of the Judicial Review. Somewhat frustrating as my former adjudicator was supposed to be chasing it up but then left the FOS and then this review kicked in.
How come some claims are still being paid out or is it just certain banks still doing so?
