ESA declined as not enough NI last 08/09 is it worth appealing?

As the title really!

I'm putting in claims for ESA & DLA but ESA has been turned down because I havent paid enough NI, but I'm not sure how that is worked out as I was on IS as a lone parent untill I started working in june/july 08 and then have been employed to date, I have had alot of time off sick the £70 a week one not works scheme does that mean my NI wasnt paid?

What should I do now?

    The rules on NI conts are really strict so I would doubt you would have any grounds for appealing.

    Can't you go back on IS - how old is your child?

    Edit...just read your sig - are you still a lone parent and if so you can claim IS
  • As Loopy Girl says, it's unlikely that you would be successful in appealing the decision of not having enough NI contributions to qualify.

    Do you satisfy the means-test to apply for Income Related ESA? If so, did you apply for that?

    No im not a lone parent anymore & the woman on the phone said my OH earns to much to get income based ESA, he's on £22k? hmmm guess I'll have to try and carry on at work!

    Sounds about right...am assuming you are claiming your CB and any CTC.

    Yer we get CB, CTC & WTC for them both, Welfare officer said I should be awarded atleast middle rate care, and should probably get some CTB & LHA when thats awarded, Does Middle Rate Care give you the discount on CT? and how does it change our tax credits can we still get help towards childcare?

    From the history you have given it is unlikely that you satisfy the NI contribution conditions for ESA. But if you think it may be wrong you can check the conditions here http://www.dwp.gov.uk/docs/m-49-10.pdf and if you think it warranted appeal using this form http://www.hmrc.gov.uk/forms/ca82.pdf

    I am slightly confused as I was on IS for the complete 2008-2009 tax year and thought you automatically bulit up contributions during that period? This year i've been a mix of IS, working, sick & MA. so have no idea what my NI is like!

    If he's on £22k, why does he get WTC? The cut off is around £18k.

    you get NI credits but that's not same as NI contributions. Credits build up your pension, contributions help you claim contribution based benefits.
