reclaim on car insurance

I just wondered is it correct that insurance companies can up your premium based on an unsettled claim. My partner had an accident which the other party disputed and as a result went unsettled for 4 years. We took out insurance with Admiral and they added a further £170 to the premium for the unsettled claim. Does that mean it has been higher for all those years? Also now it has been settled in court and my partner is not to blame. So are they now responsible to refund the extra bit they charged or do we just have to suck it up?
