Moorcroft Debt Recovery HELP PLZ

Hi i have been looking through different sites and forums for hours and hours, am not really sure how i stand and what i can do heres are my problems

First off all my debts are with lloyds i have a loan and a overdaft and a credit card.

my loan is £1870 (which Moorcroft have now)
my overdraft is £775
my credit card is about £1000(which i pay £5 a month so happy with that)

I have been paying lloyds £35 a month for my loan and overdraft for about 2 years now but this month i get letter from Moorcroft saying i have to pay them now, so after being on the phone with lloyds for a hour trying to sort it out and being told i would have a manager call me which they didnt, it would seem the i am stuck with Moorcroft now

Moorcroft are rude unhelpful and bully you and said they will take me to court. anyway my problems

1. I paid Moorcroft £45 today and they say i have to pay another £50 each month which i just dont have that sort of money spear, they say if i dont pay them they will take me to court and charge me interest, what i would like to know if i pay say £20 into there acount each month can they charge me interest? and if i went to court what would happen(who pays court fees, would i end up paying more)?

2. Can i send Lloyds my phone bill to pay? as it dont seem right i should have to pay for being on hold and getting no were.

3. Now that Moorcroft have my loan can i get PPI back from my loan? i did my loan online and ticked the box for PPI so would i get it back?

4. Is there somewhere i can complain about the company as am not the only 1, if u type Moorcroft debt recovery in to google if comes up with nothing but complains, how is a company aloud to trade like this??

Am not trying to get out of paying my debts or pay the min but i only have about £50 a month to spear i work part time and dont always have work

    I am no expert in this matter, but in my opinion I would do an expenditure sheet and sent it to them, showing your income and outgoings, explain that you can only afford £xx per month. If they are not happy with this, they can of course take you to court, but in reality I think it rarely happens, they simply threaten it. Court costs do vary, from experience around £30 - £70, but if you can prove that you offered a payment that is reasonable when you consider all of your income and outgoings, a court will agree to that amount, they may also penalise them for not accepting the payment you offered>

    You should post this thread onto the "Debt free wannabe" board where you will get advice on how to deal with Moorcroft.

  • Firstly,

    NEVER EVER call a debt management company. They will pressure you into something you cant afford and get deeper in a mess. They will also threaten things to scare you when in reality it can never happen. Their first letters they send are also scare tatics, don't worry you have a lot of help on your side.

    Always communicate in writing, that way they have to tell the truth when they reply as its a hard copy. If they keep phoning you then say you will only communicate in writing. If they persist there is a letter threatening them with harrassment and they will back off quick.

    Do and income and expenditure showing the debts and how much you can offer per month. Put the offer to them in writing.

    Lloyds will use Moorcroft if the debt is lasting longer than they thought. Dont be alarmed this is how every debt company works - no point in complaining. Treat them as you are in control.
