partner ill...need leave from work ?

my partner is due to have extensive foot surgery on thursday, i
approached my work as i will need the week after surgery off to take care of him (he has no family in scotland).

I currently work for nhs24 and have found them really unhelpful basically stating im not entitled to any paid leave (for any of the shifts) and will only give me annual leave for the weekend (have refuse annual leave for the day he gets out of hospital).

I was aware that some of the days have to be taken as annual leave, but I was sure i would be entitled to some sort of paid leave even for 2-3days? i feel really let done by them and dont know what to do as there is absolutely no way i can leave him on friday night alone unable to even get to the toilet ! what should i do ?.

    no, there is no entitlement to paid leave. Basically if he cannot manage on his own and you cannot look after him the alternative is that he stays in hospital.

    Well as you have been advised above, he stays in hospital.

    There is no automatic right to any paid (over and above contracted A/L,) unpaid or compassionate leave under UK employment law.

    Individual employers might allow the above, in which case it should be stated in your staff handbook or HR policies. Have you checked these, just in case the person you have spoken to is unaware of any allowance ?.

    Otherwise, do you have any relatives that could help, or could one of his relatives travel up to Scotland and stay while he needs help ? Or as a last resort get a private carer in for a few days.

    entitlements for this kind of leave really do depend on your individual employer, so I doubt many of us could advise.

  • this is my problem though, nhs 24 has a range of special leave circumstances, but they deemed this as not meeting the requirements criteria. my mother is manager (who is responsible for over 190 staff) in Nhs GG&C which adopts the same policies, she is telling me that i do meet the criteria
