Can anybody assist?
A long story short.......my former employer was insolvent, company was liquidated, all staff were made redundant, business slipped across to a sister company, no cease of trading, all staff (apart from me) offered new terms same day, business carried on, I took former employers to court through the Employment tribunal Service, won my case, date has passed for them to pay up, interest is now running daily, they offered to pay up over a period of time (which would have taken approximately 2 years) I said no, Sherriff Officers will now formally serve notice on them giving them 14 days to pay in full.
The business has seamlessly carried on trading throughout this period, and will continue to do so. I have been told basically they can put the company into liquidation again, it can slip across to another "sister" company, and I will receive nothing!

how much you talking about and whats wrong about being paid in installments?
Could you have negotiated a smaller payment period, ie 6 months? The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

Total is 30k, having worked for them, I don't trust them to keep up the payments. If they can't raise this sum they should not be in business. They have previously done the same with other companies they have been involved with, they are the classic "phoenix" rising from the dead and starting again, while walking away from substantial debt. In my situation there were other creditors who received nothing. I will see if they respond to the notice that will be served, I may then possibly negociate a shorter repayment term.0

I'm afraid this is correct - if the company trasnfers its assets / business to another company then you are left with nothing. Enforcement can only operate against the respondant, and in the case of a company, against that particular company. It unfortunately happens a lot.0

I won a case very similar once where i was owed approx £1500 wages and i never recieved a penny the crook who made me and several others redundant switched bank accounts with government funds and myself and others went to mps etc to newspapers and kicked up a right noise but we got nothing it was a few years ago in 1992 but it still hurts. Then when i went to sign on i was told i wasnt entitled to anything grrrrrrrrrrrrrrrrrrrrrrrrrrrrrHi, we’ve had to remove your signature. It might be possible to freeze their bank account/or sieze their main assets, which in this case would be vehicles, which might in turn put them out of business. The thing now is, whatever I do will cost me money, without any gaurantee of ever getting the original sum back. The so called directors have been through this scenario before, so they know the game, but if I am not paid, I will cause them as much grief as possible, and do my best to have them investigated, and struck off.0
