help! am being chased for brothers debt!!

i would be greatfull for some advise please!
The other day i recieved a letter from a loan company called flmloans.
it was addressed to my brother, but my address.
my brother has never lived or had letters sent here!!
i opened it , as i havn't spoken to either of them for about 3 years, and wondered why it was in my address. apparently, they had a loan, and from what i can gather, have not paid for it.
i have since found out that they have split up, and are getting divorced, and her mum stood guarentee for the loan.
after phoning and telling this company that i no longer speak to my brother, and have no idea where he is, they said they can't take my address off (which was given by his ex wife, as she had been here before, and thought she'd give them it!!!!), untill my brother contacts them:mad:
i am constantly getting letters from them, i send them back, but am now worried that they could send someone around my house, and my daughter /son opens the door to them!!
is there a template letter that i could send to help me, i don't even have the same surname as him!
i would be very greatfull for any advise please, or do you think that i maybe should go to the citizans advice and ask them to help me?

It sounds like your mum is guarantor for the loan. This means she is responsible if the loan isn't paid.

I would try the other tacktic and reply to them and state that no one of that name lives here. The omus is on them to try and trace him to a correct address. I would tell them in a letter that no further corresponce will be sent from your self and you would appreciate them not sending any more letters as it is very distressing to you.
Or just give the old address he lived at when you last spoke or even his ex or ex mother in law's.BSC member 137

It may be a scam either by this company, or even by your brother, if you don't talk anymore. You can't rule anything out. Call the police if you feel they are harassing you. They may be able to contact this company, or simply see if they are a legitimate company (or maybe you could do that yourself). Whatever you do, don't let it affect you or your family. Get more advice from friends.0

I am not qualified to give advice but from what i have read you will be fine as im sure the address does not normaly take the brunt. Some one will point you in the right direction and good luck.0

i don;t think its a scam, i just think that my brothers knocked them!!
i gave them his last address, which is where his ex lives, but obviously, she has pointed them to my direction!! i think i will write to them and do as you all advise, and tell them he isnt here and to not harass me as i don't know anything about it!
maybe i could use a template letter from this site.

Redroo, if your life is being made a misery by this then that is because you're allowing that to happen. Totally understandable, so I'm not having a go, but you might feel more reassured if you're aware of a few things:
Credit ratings/histories are per person, not per address... so your brother's credit ratings won't affect yours.
These people are debt collectors, not bailiffs. They have no power to come to your house and demand money or anything else for your brother's debts... in fact they wouldn't have any power or "right" to go to his actual house and demand anything either. All they can do is write nasty letters.
Keeping those things in mind, the best thing you can do is send the letters you've already talked about and then proceed to do one of the following things depending on how the mood strikes you.
Either: throw any further letters away unopened and totally ignored.
Or: write on them "not known at this address", cross out your address and shove them back into a mailbox, without opening or worrying about the contents.If you don't stand for something, you'll fall for anything0 -

hi there, thanks for the info, i am not so worried about bad credit rating, its purely the thought that they could send someone out to my door, and my son or daughter could answer it!! i know that legally they would have to go to court to get bailiffs involved, but its also the thought that there are some really nasty people out there that run companies illegally!!,
But being as you are a former bailiff, it has set my mind at rest quite a lot, so i am very greatfull to you and everyone else, and will just keep sending the letters back! xxi keep losing weight, but it just keeps on finding me!!!!!!:D0
