Yorkshire Bank Visa Card Arrears

Hi everyone,

Can anyone help with advice.

I have a Yorkshire Bank Visa Card and a Yorkshire Bank Current Account

I missed two payments on my Yorkshire Bank Visa Card for various reasons.

Then i received a letter from my Visa Card Account telling me they had taken £121.00 out of my Current Account. A week later i had a letter from my Current Account, thanking me for requesting a Direct Debit form to fill in. I didn't fill it in.

At no time, ever, have i requested any Direct Debit Form.

What i want to know is, is it legal, can they take money from one account to pay another without permission? I would never give that permission and they would never find any recorded message of me agreeing to that. They have never done it before. and would they put my Current Account Overdrawn to pay my Visa Card?

I have never ever heard of this happening to anyone before.

I hope someone can help.........

Thanks

Jacqui :(

  • Sorry to be the bearer of bad news but this is legal and has been done before and will be done again. It makes no difference that you haven't signed a d/d form. The process is called offsetting and will be in your t&c's.

From memory they cannot take you overdrawn, although someone else may correct me, however what often happens is that a later direct debit will make you overdrawn.

You already have when you signed the credit agreement.

    It's called right to offset.
