nationwide creditcard

I have had a nationwide creditcard since 2006 untill last september I paid balance off in full. My husband has MS which has now rendered him unble to work prior to him stopping work he without my knowledge spent ALL our savings over £20,000 on a garden design exhibiting at a major flower show he told me he had full sponsership for this. I only found out he had spent the money after the show so it was too late to stop any of it going out he had never had a sponser but wanted to do it as he thought he may not be able to in the future. I have stayed with him as the MS has got far worse it affects his short term memory and he has very bad mood swings so to sum it up we are now on benefits trying to sell our house which I too worked very hard for I am the only one who has credit card debts as they were racked up whilst he was spending on the garden as I was assured we would get the moneyback in full. Nationwide have just sent me a letter/form stating that they intend to take me to court to retrieve the balance of my card £5100. When i got in difficulties 6 months ago I contacted them to explain I could only afford to pay £50. per month they agreed and set in place a 3 month agreement ( I cannot work as apart from being a carer to my husband In the last 3 months I have had 2 surgeries for arthritis in my joints and have been basically housebound myself. Anyway back to Nationwide when that 3 months was up I re filled out the expenses form for them gave them the same details advised them we are selling our home on for £500,000 and could only pay 25 which was agreed that expired last month they started to demand full amount so I contacted them again went over details again and complained that it was very unlikley until we sell the house the situation will change as my husbands condition is incurable and the prognosis is not good they said they would get back to me about my complaint with an answer about my payments that was in june. Yesterday I received the letter saying that if I did not pay the full amount I would be taken to court in swindon to recover the debt and court charges please help me as I am so scared I feel they have been totally unfair with me I have tried but supporting a family of 5 on benefits is so hard when we sell the house we will be ok as we have nearly £300,000 equity in it so why are they doing this to me I have written this as I cannot talk to my husband about it as he is ill and gets really agressive if i complain /query anything with him I cannot talk to family and friends as i am embarssed. If anyone has any advice [please help me

    You don't mention whether or not you are paying anything to NW since the agreement ended. I would continue paying them regular sums, perhaps the £25 per month if you can still afford it.

    It might be best to get some outside help to deal with NW such as CAB, nationaldebtline, paypal or cccs. They will write to NW on your behalf and submit to them a Financial Statement and ask for the interest to be frozen. They will also offer an appropriate amount from your income as a payment offer. You can try this yourself if you like while you are waiting to talk to a specialist. If you go on nationaldebtline's web page they have template letters and show you how to prepare a financial statement.

    Quite often I've found that without outside help the creditors just will not co operate or negotiate- its totally wrong but that's my experience.

    Nationwide are being very shortsighted. Here's a person who is willing to pay and will soon have the funds to pay off the debt in full and they will not play ball. They are being very silly.

    You also have to look at whether or not you are actually liable for the credit card bill if he used it without your permission

    My advice is to get advice on this issue so you are not left to deal with it on your own. In the meantime eitherget a Financial Statement done via nationaldebtline website, send it out with your payment to Nationwide or use the template letter to ask for the matter to be put on hold whilst you get specialist advice - if you do this, it still might be better to send a small payment at regular intervals.

    Ring them up, don't waste time writing. If you are paying less than the minimum payment they will only set your arrangement for three months at a time. I believe they may freeze the interest but don't quote me. Your income and expenditure will probably only be valid for 6 months - used to be 12 but nowadays and update is required six monthly. The problem is that you have a house, all that will happen is that if they take you to court they will attach a second charge to your property, that means after your mortgage is paid off they will be paid next.

    Try not to worry to much, but re complaint, put that in writing and head it up complaint and it will have to be dealt with by the complaints team.

    Not everyone are ogre's the problems is that invariably if you write, it gets date stamped when it arrives and is then worked in order of receipt, problem being is that there are so many people in this situation the post situation is backlogged.

    Try not to worry too much but keep paying what you can afford ie don't not pay waiting to hear from them because at least it will show that you are trying to make payment.

    I stand by my advice to write with or without a financial statement. You tried phoning without success. It might be worth trying again tho before you write.

    To get a charging order the company will have to go to court and justify it and you might sell before then. Its still a possibility but not commonplace to secure via way of a charge on a unsecured credit card.

    Nationwide are being very silly. It might be worth putting in a complaint to the FSA once this is all sorted.
