Received Penalty charge notice, disputed and lost advice please.



  • Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I have drafted a letter from advice on the great site Pepipoo. I would appreciate any opinions on this. Im not great on legal spill so any help would be greatly appreciated.
    I am tempted just to pay it however part of me is dying to see the outcome.

    To Whom It May Concern:

    I would like to make representation on the grounds that the representation options are fettered on the back of the PCN.
    If I want I can tick all the boxes, but even if I didn't want to, the fact that they you have put restrictions on my statutory rights is a procedural impropriety.
    Also on the front page of the ticket says essentially
    "If this is not paid within the 28 day period then the fine may go up to £180 and you get a charge certificate".
    Surely it should say "If this is not paid or appealed........"? This seems to be an erroneous description of the process and prejudicial.

    Glad to see you've got some responses on pepipoo, they'll give you the best advice as theirs is a specialised motorists' fightback forum. We are a bit more general in our advice on MSE as most of us don't have the legal expertise some of their great posters do.

    Just a suggestion, I think I would leave out 'but even if I didn't want to' in the bit about the reps.

    (I only used that phrase to explain to you that it's procedural impropriety even if you hadn't wanted to tick several boxes).

    So see what pepipoo say first, get an appeal in based on their advice, as I don't think you've actually appealed as yet. Can you re-post those links with the evidence photos & the new letter from the Council?
