New Job - No employment contract

    So - OP - how exactly do you know that your contract is coming to an end if you hadn't got a contract?

    They told me at interview and in the job advert from the newspaper it was an initial 9 month contract that could become permanent.

    So you've got another 5 months to go then? So how exactly is it coming to an end soon? Do you not want the other 5 months work?

    Since you are sooo worried about this i would just ask HR or the agency politely to provide you with the details in writing (and this doesn't have to be a full employment contract, just the confirmed details of the post etc as someone above says).

    Trying to go to tribunal for a few bucks in the pocket for a purely technical failure and no real actual loss is not sensible and will not succeed. If anything you will just jeopardise the 5 months of remaining work due to creating a bad situation between you and the management of the company.

    Note my emphasis, and also bear in mind how long it can take to get to tribunal.

    And remember, it's not just the next 5 months of work you're jeopardising, but the possibility of a permanent job. And all because you have not received anything in writing, for which you haven't actually asked. There could be a perfectly innocent explanation, from it being lost in the post (internal or royal mail), to someone thinking someone else has done it!

    I have a place for University starting in September. They dont know that I will be leaving before the temp contract will expire. In the meantime, whilst the job is easy going, the 1k I could have had from the tribunal for their breach would have been helpful for starting at uni - but ive realised its not that straightforward to take them to the tribunal. Im grateful for the sensible words of advice here as without it I would have gone ahead thinking I had a chance.

    There isnt specific legislation. But an employer could be sued for defamation if they said anything that wasnt 100% accurate about a former employee.

    That's all anyone will ever need to say to ensure that any job offers are withdrawn, and there would be not a thing you could do about it if it were true.

    Here's another: "T800 was originally employed on a nine month contract but left early."

    Also remember that some employers ask in their reference questionnaires "Would you employ this person again?" No defamation involved in saying "No".
