CCJ help!!!

hi i made a topic some time ago about being taken to court..

well i got the result i don't know how but out of nowhere i got a letter telling me i have a ccj and i have to make £50 payments each month ... £965 in total

thing is this month i lost my job. i live at home with my mum and dad what can i do? they won't run in my house will they?

    O.k did you defend yourslef against the ccj? You may be able to get the judgement cancelled if you weren't aware of it in time to file a defence.
    If you did know about it and they followed the correct procedure then you need to apply to court to get the repayment set at a rate you can afford.
    Have a look on National Debtline's website- they have loads of useful factsheets on these types of things.

    hi thank you so much for your reply.. yeh i acknowledged the court online and told them i would like to defend... then i herd nothing back until this letter came to my house telling me i have a ccj

    Um not really my area I'm afraid- did it say once you have said you want to defend then you have x number of days to submit a defence?
    You really need RAS or someone like that on this one.

    yeah i did i planned to have more time so i could pay it off but as i lost my job i can't if i want to pay it off do i just send them the money? and i dont have a cheque book would postal order be ok for £950?

    If you did not submit a defence then I think the CCJ may have been awarded.

    The link below gives information as to what to do if you can't pay

    Specifically it says "If you cannot afford what the court has decided you should pay, you can apply to the court to look at your offer again. This is called a ‘re-determination’. There is no fee for this. You must do this within 14 days of getting the order. You can do this by simply writing a letter to the county court. Quote your case number. Attach your personal budget sheet and explain why you disagree with the order the court has made."

    There are other procedures after 14 days.

    The national debtline has a free phone number that you can call for advice. If you print off the fact sheet it will help you explain to the advisor what has happened so far. The key thing is you have been asked to pay an amount you cannot afford, but you need to consider what you can afford given all of your committments (if you haven't already you need to fill in an income and expenditure sheet)

    Supakid - just re-read your post. Either you can or can't pay it off, decide which it is. There will be info about payment methods that will tell you how to pay them.

    hi thanks for getting back to me..... basically my brother saw my laptop while i went to the shop and confronted me about this.. i told him everything and he has decided to help me pay this of and send them payment in full on the 25th of this month.. what i wanted to know is how do i go about sending them the money?

    http://www.direct.gov.uk/en/MoneyTaxAndBenefits/ManagingDebt/CourtClaimsAndBankruptcy/DG_10013083 there is a section called "Who do you pay?", I am guessing this will give you the information. Pay within the time limit to prevent it baing added to your credit record.

    You are very lucky having a brother who can help. I suggest you do some reading on the national debtline website so you know more. And have a go at sorting your other debts by agreeing payment plans (of small amounts) - it will save all of the panic in the long run.
