underpaid tax credit and pension question

My wife and I are currently bankrupt and we have paid 1 month IPA but have not paid anymore due to change in circumstances (OR is reviwing our SOA we sent him)

When we filled in our child tax renewal form it stated we were due to get £40 every 4 weeks (£35 drop due to youngest child turning 1) but on the renewal form they stated we would get this if our income was between x and x. Our income was actually less then this and will be again this tax year so I phoned up and done the review over the phone but they couldnt tell me how much I would actually get.
I have checked my online banking and we have had 2 payments from tax credits go in. 1 for £407 on 27/05/10 and 1 for £157 on 28/05/10.

1. Do we have to tell the OR about these payments, if so would he take them off us and would it be the whole ammount or a %?

2. I have never joined my work pension due to needing every penny I earnt to pay bills etc. Now I am bankrupt would I be allowed by the OR to join my work pension?

cheers

    Hi tvaustin,

What you could do re your tax credit is to give them a ring and ask them what the new payments are - your confirmaiotn is probably in the post. Now the updates have been done they will be able to give you an answer.

I think you have to let him know about the payments - not sure if they would take a small amount esp as it's child tax credits.

Not sure where you would stand with pension. YOu could ask you OR if you can make payments direct from wages - if your SOA allows for this - as in you can live without that money. Some will be along later who will no more on this.
