When BR, no IPA, now due to be discharged and have an IPA?

Hello,
I'm due to discharged next month. At the time I went BR I completed and income/expenditure and they deemed there was no surplus income and no IPA was put in place.
I had to recently complete another one (as I'm due to be discharged next month) and my income/expenditure is roughly the same, but now they deem I have surplus and have slapped an IPA for 36 months????
I know I can dispute this and I will but I have 2 questions: -
1) can I ask them for a breakdown so I can see which of my figures they deem excessive?
2) if I dispute and 'win', and they say that no IPA is now due, can they then reassess me in the future and put the IPA back in place? Or once discharged with no IPA, does the OR have no further interest in me whatsoever?
Many thanks

1) yes you can
2)If you dont get an IPA by discharge they cant give you one afterwards
Why dont you put it up on here so we can take a look, how much is the IPA forHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
Ask them for a breakdown and then take it from there.
It sounds like the examiner accepted your figures in interview, but someone else has received your more recent SOA and may have reduced some figures.
IPA can only be put in place whilst you are BR, they cannot impose one after discharge.0 -
And dont forget the 'allowences' in the guidelines dropped in march, so if you where borderline , it may be why you are seen to have a surplus now.0

Uh! I guess that I missed this. Do you have any details of the changes that were made? I emailed Moon Beever at the beginning of May with details of an increase in my income and am still awaiting the new amount. I'm a bit worried now!!0 -

Hi Fermi,
Thanks for the quick response. Thankfully, the new figures shouldn't affect me too much.0 -

Hi Debtinfo,
1) OK i'll ask for a statement now
2) Figures below: -
Total income £2270 (wife and I)
Mortgage £517
Council Tax £76
Heating/Lighting £120
Water £50
Telephone £75
Housekeeping £550
Essential travel expenses £560
Clothing £200
Other essential payments: -
Life insurance £20
Road tax £40
Car maintainence £50
House/contents insurance £83
Total £2341
They did say that my outgoings are greater than my income, I said it fluctuates slightly month to month.
I submitted almost exactly the same figures when I went BR (my mortgage was higher, housekeeping lower) but now they deem I have £260 spare?
Im a travelling salesman so the Essential Travel costs are accurate!
I DO NOT want to be subject to an IPA for 3 years and desperately want to get on with my life!
Thanks

Hello JCS1,
Once I'm discharged and if no IPA is in place, can I (outrageous example) win the lottery the next day and they cannot then reassess me and put an IPA in place?
Thanks

Hazy, how many people is that SOA for? Is that your OH's full income?
If you are discharged and have no IPA and come into money then you get to keep it.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0
