Recived a Claim Form For CCJ Advise needed please

I got one of these today from Northampton county court, on behalf of a debt collecting agency from an old credit card debt with MBNA

Just wondering what my best course of action is?

Do I first fill out the acknowledgement of service and send to the court?

And then send a letter to the debt collecting agency asking for a copy of the CCA? I have found a template on the internet for this already?

Just after some help on if this the correct thing to do, as I am worries if I put in the acknowledgement of service and then subsequently find out that I am liable for the debt, will I still be entitled to admit to the cliam and to arrange to pay the debt off monthly?

any help would be appreciated, thanks in advance.

How old is the credit card? When did you last pay anything towards it?

Think I last paid anything towards it in around 2007, the card would be from around 2002 I think...

    OK

If you have never asked for the CCA, then it is too late for a CCA request now.

Do you have the default letter? Whe you were told to pay up the whole amount within 14 days or they would terminate the credit agreement?

You need that if at all possible, as if it is faulty, you can fight this case with no other documentation.

if you find it send a pm to 10past6, i have to go.

No, they've commenced litigation, you're now passed that stage.

The above paragraph doesn't make sense, you MUST acknowledge service, this must be done irrespective of your next step.

Once you've acknowledged the claim, you have a further 14 days to either admit / dispute / deny the debt, if you admit the debt, then a monthly payment plan should be set up, if you disagree with the debt / amount, then you'd file a dispute under the claim, if you deny your liable for the debt, then deny the claim within your defence.

    Thanks for the replies.

I've acknowledged the service online now.

I'm not sure if the amount claimed is the amount owed, do I contest it or just take it as given?

Do I now just send the admission form to the claimant within 28 days? I am going to ask to pay in instalments....

I might be able to raise a lump sum in a few months, if they agree to accepting my instalments is it still possible in future to then make them a full and final offer to settle the debt? If I can do this what is a typical % that you should offer?

    Thanks
