Soon to be discharged, questions about starting work

I've been unable to find work during my BR and now that I'm coming to the end of it (12th July), I figured I should just wait it out for a little bit longer so I don't have to deal with an IPA. I'm not exactly sure how it works though. Here are the options I've thought of, can anyone give a bit of input on them.

1. I don't start work until after the 12th of July so I physically haven't earned any money that the OR will have an interest in. This seems to make sense.

2. I start work, but I do it in a way that I wont actually get paid until after the 12th of July. Will this be okay, or because I've actually earned the money during the BR will the OR still be interested in it even though I received it after discharge.

3. Or I just start work in June, I'll only have had one payday during the BR and I'll be discharged soon after and the OR will then drop my case and never find out. I'd rather start work ASAP, but is this a stupid idea?

It will probably seem like I'm worrying over nothing, but I just don't want to do anything wrong :( Just trying to get my life back on track ASAP.

    2. Not likely to happen; you need money between now and then and few employers would do this anyway. Plus, as you have earned money the OR would be cheesed off and a potential BRO may be sought as you would be deliberately hiding/retaining money etc.
    3. You MUST tell the OR within 21 days after a change in circumstances; you signed a legal agreement to do that. This applies whilst you are BR or in an IPA.


    As to paying an IPA, you only pay a percentage of your surplus you know; not the whole amount. You may not even have a surplus after totting up your outgoings.

    If you started work 20 days before your discharge date you wouldn't need to inform the OR - you have 21 days to inform OR but if you are discharged within that 21 days you're in the clear.

    I can understand why if you have come this far you don't want to rock the boat but you need to do what you feel is best for you.

  • I know I only pay a percentage, but if I only have to wait a few months, I just thought I may as well. My car is falling to bits and I'm going to need a new one when I start work again and having an IPA for the next couple of years will just make it much harder. I'm going to have to save up for a new place to live too, and right now I don't have much outgoing, so the percentage would be the 70% which would make it super hard to save :( I'm getting by on job seekers allowance at the moment, so holding out for a little bit longer isn't a problem

    Thanks :) waiting a bit longer isn't a problem, I'm just confused about how it all works.

    I've just applied for a job that pays £5k more that what I am on
    My IPA will be reinstated - this was removed once my OR left

    However I will still be better off each month that I am now, and I will be 10000 times better off than before I went BR.

    But that just me......

    I know, I'd rather just wait an extra 2 months. Right now I don't have anything outgoing so if I get a job earning around £15,000, that's around £1000 a month after tax, £700 of which will have to go to the OR. It makes sense for me to wait a couple of months and have that £700 to put towards a new flat instead of dealing with an IPA for 2 years. I'm just not sure how it works regarding my discharge date.

    If you've made the decision to wait have you thought about any short courses/hobbies or anything to do in the meantime? You may as well make good use of the time you have.

    Ohh, I thought it was 3 years from the start of bankruptcy. That's even more reason to wait then.

    I've been trying to do lots but it hasn't been going very well. OPen University messed up my application which prevented me from doing the course. Learn Direct can't fund any courses for me because I already have level 2 qualifications. I have been doing a book keeping & accountancy course though, although I'm a bit worried that my BR will prevent me from getting a job in this field.

    So, as long as I start work AFTER the 22nd of June (20 days before discharge) I'm not doing anything wrong, everything will work out fine and the OR will have nothing to get mad about? Sounds good.

    Its 36 months after its implemented no matter when that date is.

    Thats good that you've been making the most of your time. Bookkeeping would be fine but if you are doing AAT or equivalent you may have to see if there are any restrictions. Skylight should know more about that.

    As far as I'm aware you would be perfectly within your BR contractual obligations to start work 20 days before your BR is discharged without having to inform OR. I'm sure if I'm wrong someone will come along to say.
