I hope I'm not being stupid here, I've just looked at my credit file from Experian as I'm trying to get myself straight.
I have a number of defaults which are all "justified". However I seem to have two defaults for one debt - both entered on the same date, one is registered by the OC and the other by the DCA.
Is this correct? :huh:

Its 1 default per debt, so with the DCA or the OC should remove a default.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Should I write the same letter to the both of them asking one of them to remove?
At the moment I've "got" them on unenforceability, will writing to them do anything negative?:beer:0 -
No, if the CCA is faulty, it is faulty and that won't change. But it is solid that only 1 default per debt is allowed by the OFT.
Out of interes are the default placed dates the same for both defaults. That is the date in 6 years of when it will fall off. DCAs have a habit of setting the wrong dates.
What probably happened is the OC placed a default, then did the DCA, but the OC didnt remove the default.
You should also have had a default notice and notice of assignment to get the defaults placed and new DCA default placed.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Both defaults were placed on exactly the same date back in 2007 and the default sum is exactly the same. Basically every detail is the same except one is the OC and one is the DCA.
Unfortunately, I don't have the default notices as back then I had my head well and truly buried!
I guess that now the DCA owns the debt, I should write to the OC to get their default noticed removed?:beer:0 -
Yes the OC's default is the one that should be removed, if you write to both you might get lucky and both removed but i very much doubt it
