Harassment via telephone

I separated from my husband last September- he left suddenly. He hasn't made any contributions to any household expenses since.
As a consequence I have struggled to make minimum payments on my capital 1 credit card. I have written to them THREE times since September- October '09-to inform them of my financial situation, January '10- informing them I had secured work and would continue to make nominal payments until such time as I could resume minimum payments and three weeks ago I sent them a copy of the budget that it to be submitted to court as part of my divorce proceedings and to ask them again to freeze my account. I am being telephoned 5-6 times per day- via my landline and mobile phone! The last being at 20.55 this evening (29/03)
When does the frequency of calls become harassment?
I have kept them informed of my situation and am making nominal payments regularly.
What more can I do? Suggestions gratefully received!

It's beginning to affect me mentally- I have a history of depression and if I lose my job capital 1 will get nothing!

    You cant blame them for trying to get their money, they are running a business after all!
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    Have you tried answering the phone and discussing the situation with them?

    There's a form letter floating around the DFW boards that informs creditors that you're aware of the rules and your rights with regards to harassment and that you'll only deal with them by mail.

    Dig that out and send it is my suggestion. With that done you can then do some serious complaining if they continue.
