Cancelling Swiftcover car insurance but they want money, how, why?

    You won't lose any no claims as you're not the one being claimed from/in the wrong. If Mr Jeep's insurance co. agree that it's his fault, it's his no claims that will be affected.

    Did you exchange details with him at the time?

    I have got his details, but not the name of his insurer, I have his name, registration plate, I wrote down where it happened, when and how. I have told my insurance this too.

    He already said he is not accepting liability (he was very stubborn when I was trying to be polite), so if he don't accept liablity and obviously I wont for the reasons told, it will go down as a split thing which would result in me losing my claims?

    That's my only worry, the no claims, something that isn't my fault, then me suffering from it including premium rise.

    Don't worry, people generally will not admit responsibility even if it's blatantly their fault. Were there any witnesses/CCTV to back you up at all?
    Your insurance only covers the costs of repairing the car of anyone you happen to bash into, it won't cover anyone bashing you so it can't go 50/50. Whatever happens, you can't lose your no claims as you can't claim from your insurer.

  • Thanks very much, that makes me feel a bit more confident now.

    No CCTV as I'm aware, i tried to stop the nearest person but they drove off, as most people do in modern day Britain!

    I asked my insurer about the no claims when I reported this, they said I could lose them, but as you said I never hit the person, i was hit so this surely cannot be the case.

    You could go on http://www.askmid.com/ownvehicle/ to see if the vehicle has insurance. I always carry a disposable camera in the boot of the car. That way I can take pics of the incident.
    My advice has no basis more reliable than my own meandering experience.
  • Thanks, i never though about that, but i took pictures of the damage to my car, smashed passenger side headlight and where he went into the side seems to have damaged my steering frame a bit, I was lucky I wasn't a second later.

    Did the six cars behind you are drive round the wreckage then?
    I'm trying to work it out.

    In future try to get independent witnesses. Your passengers won't count as they are assumed to be biased, but anyone driving another car or walking and not involved.

    I woud question what gir-in-a-hat said
    you can't lose your no claims as you can't claim from your insurer.

    The other guy can claim from you and if he won you would lose your no claims.

    A friend of mine had a similar incident (on his motorbike and his leg is mesed up).
    He swears he's in the right but it's going 50/50 because the witnesses were split equally.

    Hi, thanks for your reply. There were hardly any wreckage and the road is big, 2 lanes so people drove past, the person i tried stopping drove off.

    Swiftcover, I am already in contact with you guys so thanks.

    Also, I haven't put in a claim to his insurers yet, not sure if I should? I'd rather fix the damage myself as it will cost me £100 max, I'd rather not lose my no claims. My insurers have said that they have received nothing from his party yet and will be in touch when/if they do.

    So question is do I make a claim against him? Or wait?

    If you had proof or a witness it would be a pretty easy case (there are usually CCTV camera's at junctions etc could you maybe phone the council and ask?).

    I was hit by a driver coming off the footpath (she was parked and pulled out). I contacted my insurance company with their details and they were able to look up , using name and registration) the other persons insurance company and sort it out.

    After I got her details and she drove off a Taxi driver walked up to me and said he was waiting until she went so he could come up and give me his name and number to act as a witness which was VERY nice of him. You don't seem to be as lucky as I was though.

    When I initially called up my insurer they said that I may lose my no claims bonus if they couldn't prove I wasn't at fault or it wasn't 50/50. I had the proof though and therefore the claim was all done through the other drivers insurance.

    Nothing happened to my no claims bonus or my premiums.

    You could call the council and enquire about cameras in that area and then tell the insurance company that there is (if there are CCTV) CCTV available that proves you were the innocent party.
