Fraudulent transactions on MBNA credit card

Hey there
I went on holiday to Rome last month and used my credit card thinking it would be safer than using my debit card, how wrong was I!
I used the card in a bar to buy some drinks which came to 40 Euros. The first time it declined which I thought was strange so tried again and it went through fine, problem is they didn't give me a card receipt! On returning home I checked my balance to find two transactions at this bar, one for £358.48 and one for £313.67!!!
I queried these with MBNA who said as both were done using chip and pin they can't do anything about them. Is there anything I can do, could I claim on my travel insurance?

    Wayne, I would report it to the Police and you will probably get a crime number which may carry some weight.

    I haven't no as i didnt realise they could do anything. Would i report it to my local police even thou it happened in Rome?

    I would make a formal complaint in writing to MBNA. Go through the process and after 8 weeks if you reach deadlock go to the Ombudsman.

    Ill try that then and if i get no where i will go to the police maybe? Problem is there fraud line is only open till 5pm, so find it hard to get hold of them!

    Right at the moment it is only your word. For all we (and MBNA) know, you could have spent the evening in some clip-joint, ordering bottles of champagne (or probably Asti Spumante) for a number of lose women.

    Do you have any supporting evidence? Do you remember name and address of the bar? You should go to the police, who, I presume, will get in touch with their Italian colleagues , maybe that bar has done previously this sort of stunts to tourists who had drank too much. Contact the Rome tourist board and ask them to look into that particular bar.

    Unless you have supporting evidence, nobody will refund you the monies. After all, you could have been some blind drunk tourist, who now denies how stupid he has been.

    Well i suppose ill just have to wait till i can get hold of there fraud department and see what they can do. Just logged onto my account and they have put the transactions on hold now so at least i wont be paying any interest on them.
    bengal-stripe i understand what your saying but when the transactions are 1 min apart and both for over £300 that's one expensive place!

    Even if the chip and pin terminal did not print a paper voucher it would still have displayed the total on the LCD before you entered your pin. Did you carefully check the total displayed on the LCD before keying in the PIN?

    Wayne problem is you do not have receipts. I know its late now for that transaction.. but always take a receipt...

    there is always a receipt even if
    1) a decline occurs -- Declined receipt
    2) wrong transaction - Void receipt
    3) correct transaction- normal sale receipt.

    Wherever UK or otherwise always take your copy. I work in a retail place and see people not take receipts!!

    People leave themselves to fraud when you do not take your recepit.

    REMEMBER.. YOUR CARD IS INSERTED IN A TERMINAL IT WILL ALWAYS GIVE YOU A RECEIPT....YOUR COPY..WHATEVER HAPPENS....
    ACCEPTED OR NOT...ASK FOR YOUR COPY....

    Only way you can avoid fraud.....

    Chip+PIN-Always check the screen before punching your number in.

    If you can't remember the details perhaps you were to intoxicated.
