Is this covered under sec 75

1st question, I'v read the thread and not seen this query, if its been asked before sorry.

I paid by CC for a dealership in 2007, the company is now proving difficult to get hold of, website not working, phones not answered. I checked at companies house they have not completed tax returns since 2007, and are due to be struck off, so they have not gone into administration but don't appear to be trading. The parent company in USA has closed down, but my purchase was from UK company.
Is my original purchase covered by Sec 75.

  • What did you buy? What did it cost? Have you sent a letter to their registered address?
What is the problem you have now with the purchase?
  • Thanks for your response.
The dealership was for a licence to use the companies products, some equipment to apply them and some product to start with.
The total cost was over £3k and no single item was under £100.
I haven't sent a letter to their reg address but I will now.
The problem is I have paid a dealer fee for something that I can no longer get.
  • Please. can anyone help.
  • What goods???
Are they defective in any way or are you trying to find an angle to wangle a refund for something that perhaps shall we say is not selling very well?

Correct me if I'm wrong but I don't think your situation is eligible to claim under section 75. Claiming compensation under Section 75 requires proof of breach of contract such as receipts for goods or services not received. -- And I believe you have received the goods and services you've purchased way back.

Plus, you purchased the dealership from the UK company which is still operating, and not from the parent company in the US which has closed down.

  • Thank you both for your responses.
To try and clarify, I'm not trying to wangle/angle anything.
The dealer ship licence was supposed to enable me to purchase products on an ongoing basis, that are not available to the general public, the products are exceptional.
The problem is I bought a licence for a continued supply, that supply appears now to be no longer available.
How is the company still operating, they are not responding to any form of contact, that they previously responded to, including new orders.
I appreciate any help you can provide, I feel I paid for lifelong membership and now can't get what I paid for.

Tell us what it is then - Pyramid selling seems to enter my mind with this.

Have you got any stock left?

Lifelong membership was given to you until it closed down - no breach as far as I can - whilst it was trading you got what you paid for.

Does Section 75 of the CCA apply to business purchases?

That's what would apply to the OP.

Section 75 wouldn't cover a transaction made for a business purchase. This could never be described as anything else.

Thanks withabix and meer53 for clearing that up.
Without the need for snide comments or supposition. :T
