Think ive been set up

Hi All,
My job role is up for redundancy due to a merger, 2 people (myself and my counterpart) going for the new job (same spec) from each company and the selection criteria is :
Performance:
Skills:
Experience:
The merger project has been on the go for 1.5 (we knew nothing) years and yet this year I received an under performing which I can't understand as the previous 2 years I have exceeded expectations.
Now that I know the selection criteria I feel I have been set up, I have been with the company for 10 years and never had a day off sick, nor have I ever under performed.
We have a union which I have made an appointment with but have I any chance to get this performance rating overturned? to increase my chances of staying or should I just go with my tail between my legs
The worst thing is I hear the other candidate is not very good but it's his company taking ours.
Any help is appreciated.

We only have your view that you have not under performed to expectations, your sick days is not really relevant on this (however it is commendable)
Personally I would fight it if you can prove that the two previous years your work levels were the same as last year and you were given good reviews.Always ask ACAS0 -

When did you get your under-performing rating? What is your company's agreed process if you disagree with this? Did you make your disagreement known at the time and follow this up in any way informally or formally?0
