yes car credit reject 2nd letter what do i do now?

Hi everyone,

hope someone can help. I have just recieved 2nd rejection from yes car. they say that because I have not provided particulars of the conversations I alleded to take place, i have signed documentation stating insurance products were optional and have only raised the issue years later they are rejecting my claim.

In the last letter i also asked them to provide me with missing letters they had listed on SAR which they hadn't sent me. All letters I have been charged for. In this letter they state they have included them again and again they are missing! Can someone adives me what to do with this matter. The say their decision is final and I can contact the finacial ombudsman.

  • sorry to hear about the rejection letter,

    first of all, is this their final response, if it isn't write back to them and ask them to re-consider, making reference to the informaiton you have requested them to send you and have not recieved.

    if it is their final resonse your next course of action is the FOS, Yes Car credit should have given you details on how to contact the FOS.

    if you have requested a full SAR and have paid the £10 and then they have not sent you everytnig you need to make it clear to them in writing that failure for them to produce this information will result in a complaint to the information commision as they are in breach of the data protection act.

  • They do say this is their final response and have not provided me with the FOS details! I am writing to them again about the SAR and will mention that there are points in their letter that I do not agree with.

    when did you take out the loan?
  • took the loan out in 2005 and basically the guy who sold ppi said that if i didn't take the ppi i might not be able to take the car that day. I had travelled a long way and believed what he said. I have signed everything and I am not debating that but only because he said it would asisst with the application that day. How can i prove it happened when i signed everything. I tried to cancel the policy a few years later and was told i couldn't. This is also not in my SAR. I did not keep a record of when it was and whom i spoke to. I then had to have an operation in 2007 and tried to use the ppi and then found out it was no use to me.

  • i would do 2 things here,

    for the PPI i would go to the FOS and ask them to investigate as you have been given their final response so writting back to them to dispute this further will just waste time and delay you going to the FOS anyway.

    when you send details to the FOS i would also include the fact that the insurance did not pay out when you were out of work, as this demonstrates the insurance was of no use to you what so ever. The lender had a responsibility to make sure the insurance was sold in your best interests and was suitable for you, (this clearly was not done) and is a miss-sale in itself.

    Secondly i would write to Yes Car credit informing them that unless you recieve the information requested and mentioned within your SAR within 10 days you will be reporting them to the information commision for a serious breach of the data protection act. I would then report them anyway just for good measure.

    this is what i would do, maybe others will be able to give some other options.

    right - they're trying it on - if they've said in there rejection letter it's there final response go onto the FOS website and complete a complaint form, put in everything you've said to them and what you've put on here
