Statutory Sick Pay

I was recently off sick from work for approximately 4 months. For the first 3 months I received company sick pay (CSP). Once this came to an end I assumed I would receive statutory sick pay (SSP.

The payments/deductions shown on my pay slip are as follows:

PAYMENTS

Reference salary = £1324.55
Statutory sick pay = £184.68
Statutory sick pay-Backpay = £211.05
Company sick pay-Backpay = -£211.05
Sickness = -£693.63
Sickness-Backpay = -£829.42

Total payments = -£13.88

DEDUCTIONS

PAYE Tax-Refund = -£110.60

Total deductions = -£110.60

Net pay = £96.78

It looks like they did pay SSP but that it was taken away again. I'm assuming this must mean I don't qualify for it. I've had a look on the Directgov website re: SSP but I seem to meet the criteria.

The area manager mentioned to my manager that because I have been off sick in the past 24 months I don't qualify but I can't find this information on the Directgov website.

Can anyone else explain why I didn't qualify for SSP?

    SSP is paid by employers for up to 28 weeks to employees unable to work because they are sick. It can either be paid for one period of continued sickness or employers can link periods of sickness. I suspect you fall in to the latter.
  • I'm no expert but it looks to me like they may be taking back overpaid wages. My partners old work did this when he ran out of company sick pay, paid him it one month then took it back the next.

    If you're not being paid SSP then your employer has to tell you why and give you details of what you can claim instead.

  • Thank you for the replies, it's much appreciated. I didn't realise that savvy_sue so thanks :) If only I could get hold of someone from the payroll dept. I've been trying to sort this matter for the last 2 weeks. Our company only allow you to email payroll which my manager has done but as yet hasn't received a reply.

    Are you sure your not on Half Pay? The reason I ask is one of the deductions is almost spot on half your salary?

    The other one could be a case you received full pay for longer than you should have hence its being recovered.

    The PAYE is simply a PAYE correction.

    The £210.50 and -£210.50 is probably just a glitch.

    My suspicion is they have overpaid you OSP.

    The figures that you have quoted suggest that SSP has been paid, none of the minus figures refer to SSP so seems most likely that the problem lies with an overpayment of your company sick pay. It may be clearer if you could give exact dates for your sickness along with details of all payments made for that period.
    Judging from the figures it would appear that your SSP is being paid on the basis of 6 qualifying days per week, do you know if this is the case?
    SSP entitlement will only be reduced if you were sick for four days or more in the eight weeks before your current sickness.

    I don't think I've been overpaid CSP as I received it for 12 weeks and in a leaflet I've got that's what it says I'm entitled to.

    Yes but you need to read the breakdown not just the net sum.

    company sick pay isn't something silly like only 90% of normal pay but they paid you 100% and then they are now reclaiming it back from you?
