Redundacy Service Record

I might be facing redundacy i have been with the company for 20 years the first 18 and a half years on the tools as a joiner then i got promoted to supervisor which put me onto a monthly salary and a slightly different contract would this affect my continous service record.There is someone else being made redundant in the office after only a year after being on the tools for four years he was told he wont get anything. Can anyone help please.

    This sounds wrong if there was no break in service between the two jobs (i.e. you stopped doing one on Friday and started the other on Monday). I suppose they could be saying the other work was done on a self employed basis or paid via an agency? I think you (and the other chap) need to discuss the details of your situation with someone. ACAS are free and confidential so I suggest you call them.

    To be eligible for a redundancy payment, an individual must be an employee who has been continuously employed for a period of not less than two years. This excludes the self-employed and those working under a contract for services
  • Thanks for replies i will try ACAS and as for the record i was not self employed and it has been continious employment.

    Seems to me that they are being a bit naughty. And when I say "a bit" I mean a lot.

    If you were on PAYE on the shop floor and you're on PAYE now as a supervisor and you didn't leave between the two jobs and come back, then your "service" hasn't been interrupted, and so you'd still be eligible for redundancy. As would the other person you mention if their circumstances were identical.

    If this wasn't the case, all employers would just promote all their prospective redundancy candidates to the new job role of "victim" just before announcing the cuts and save a fortune.
