Housing benefit 2nd adult rebate

Hello

I am just asking about a cliam for housing benefit for someone else...they are currently filling in as claim form and come across the ''2nd adult'' claim section...she is retired and just on a state pension...also living with in the house is her son who is 20 and on incapacity benefit (sorry dont know the new name) ...should she be claiming this?

Any help greatly appreciated.

Yes she should fill in that section. The Second Adult Rebate (SAR) is an alternative version of Council Tax Benefit which can have the effect of rebating up to 25% of the council tax bill. Qualifying for the SAR is determined by looking at the income and savings of the second adult and not the person making the council tax benefit application.

The council will determine the application by checking:

    1. if the person claiming is entitled to any council tax benefit

    2. if this benefit is less than 25% of the council tax bill then the council will do an assessment for SAR

and will pay whichever benefit calculation is higher.

the maximum amount payable of a council tax bill for SAR is:

where the second adult is on Income Support, income based JSA and Pension Credit: 25% of council tax bill

    Has a weekly income under £175: 15%

    £175 to £227.99: 7.5%

It's possible the person claiming will qualify for more council tax benefit than this anyway.

Unbelievably a millionaire can claim SAR as it is the circumstances of the second adult and not the council tax bill payer that is taken into account for a SAR.
